1. Purpose and Acceptance
Magnetiq Agency (ABN 40 913 404 362) ("us", "we", "our") is a personalised matchmaking concierge for those seeking meaningful connections. Every introduction is thoughtfully curated, from intimate events to one-on-one matches, with optional insights and support from our trusted relationship experts (Services).
These Terms and Conditions (Terms) govern your access to our Services. You agree to be bound by these Terms upon the earliest of: submission of your online membership application; signing any membership agreement; payment of any fees to us; or any written confirmation from you.
2. Eligibility Requirements
To be eligible to apply for and maintain any membership with us, you must:
- be at least 18 years of age;
- be legally single;
- be a resident of South Australia;
- not be subject to any court order or legal impediment preventing membership;
- provide truthful, accurate, and complete information throughout your engagement with us; and
- consent to a comprehensive screening process including criminal, identity and background checks prior to approval and at any time thereafter.
We reserve the right to request evidence of your eligibility at any time.
3. Application Process
To apply for membership, Magnetiq will email you a secure, personalised link to complete our intake questionnaire, capturing personal, lifestyle and relationship preference information. This link is provided to you directly by us and should not be shared with or forwarded to any other person. Submission of a completed questionnaire does not guarantee approval.
Following submission, you will be invited to attend a consultation (virtual or in-person) to assess your suitability for our Services, clarify your intake questionnaire, and discuss your relationship goals. We will notify you of our decision following assessment. Approval is at our sole discretion and we are not required to provide reasons for any decision to decline your application.
4. No Guarantee
We will use our best endeavours to facilitate compatible introductions. However, we do not guarantee, and make no warranties or representations (except those required by law) that: any introduction will result in a romantic relationship, partnership, or marriage; you will find a suitable match within any timeframe; or any specific number of introductions will be provided beyond those stated in your membership package. To the maximum extent permitted by law, all other warranties, conditions and guarantees are excluded.
5. Membership Packages & Payment
Répertoire membership — $199 AUD per annum: An annual registration fee. Members are verified, screened, and added to the Magnetiq database, making them eligible to be matched with active Atelier members. Members are contacted only if a compatible introduction is identified. Répertoire membership automatically renews annually on the anniversary of your registration date, unless you cancel prior to renewal. We will send you a reminder notice by email at least 14 days before your renewal date. You may cancel your Répertoire membership at any time before the renewal date by contacting us at hello@magnetiqagency.com.au to avoid the renewal fee being charged.
Soirée membership — $99 AUD per month: Includes a monthly mixer event in Adelaide and inclusion in our exclusive singles database, making the member eligible for selection as a potential match for Atelier members. Minimum commitment of 180 days (approximately six months) applies. Matchmaking services are not included.
Atelier membership — $299 AUD per month: Includes everything in the Soirée membership, plus personalised dedicated matchmaking services — we endeavour to identify suitable matches, arrange connection meetings, seek and communicate feedback following each introduction, and conduct external searches if no suitable candidates exist in our database. Minimum commitment of 180 days applies.
Subscription fees (including GST where applicable) are billed monthly in advance. Where payment is not received by the due date, we reserve the right to suspend your access to the Services. All subscription fees are non-refundable except as required by the Australian Consumer Law. We reserve the right to vary subscription fees on 30 days' written notice.
By providing your payment details, you authorise us (or our payment processor) to debit your nominated payment method on a recurring monthly basis for all amounts payable until your membership ends. Direct debit is facilitated by Stripe Payments Australia Pty Ltd. Your use of Stripe is subject to Stripe's own terms and privacy policy available at stripe.com. We are not responsible for any acts, omissions, errors or downtime of Stripe's systems.
You are responsible for ensuring your nominated payment method remains valid and has sufficient funds. We do not store or have access to your full card details — payment information is collected and stored directly by Stripe.
6. Subscription Term & Termination
The minimum subscription term for Soirée and Atelier memberships is 180 days, during which the full subscription fee is payable regardless of usage or outcomes (Minimum Subscription Term). After expiry of the Minimum Subscription Term, you may terminate by providing 30 days' written notice to hello@magnetiqagency.com.au.
The Répertoire membership automatically renews annually as described in Section 5. You may cancel at any time before your renewal date to prevent the next annual fee being charged, by contacting us at hello@magnetiqagency.com.au. If you wish to be removed from the database at any time, please contact us and we will action your request promptly.
We reserve the right to terminate your membership immediately and without notice if you: provide false, misleading or fraudulent information; engage in harassing, abusive or inappropriate conduct toward us or other members; breach any of these Terms; or behave in a manner harmful to our reputation. Upon termination, your access to Services will cease immediately. No partial refunds will be provided for any unexpired portion of the subscription unless required by law.
7. Limitation of Liability
Our maximum aggregate liability to you is limited to the aggregate subscription fees you have actually paid to us over the previous 12 months. To the maximum extent permitted by law, we exclude all liability for any loss or damage arising from: the conduct or behaviour of any other member; any introductions made by us; the number of introductions made; any technical failure or unavailability of any online system; or any unauthorised access to your personal information despite reasonable security measures.
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to remedies under the ACL if we fail to meet these guarantees.
8. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold us harmless against any loss or claim arising from your breach of these Terms, misconduct, fraud, negligence, or breach of any law.
9. Dispute Resolution
If a dispute arises out of or in connection with these Terms or the Services, we agree to first attempt to resolve it in good faith within 30 days. If unresolved, we will endeavour to agree upon a resolution procedure (such as mediation or expert determination) before proceeding to litigation. Nothing in this clause prevents either party from seeking injunctive or urgent declaratory relief where necessary.
10. Confidentiality
The confidentiality of our members is of the utmost importance to us and is fundamental to the trust our Services are built on. By submitting your application, you consent to us sharing information about you (including your identity, personal details, relationship history and circumstances) with other members for the purposes of our Services (Confidential Information). You agree that you will not disclose, misuse, record or reproduce any Confidential Information about any other member; not use any member's information to contact, locate or approach that member outside our facilitated introductions; and immediately notify us of any unauthorised disclosure.
We will treat your information as Confidential Information and will not disclose your identity or personal details without your express consent. We maintain strict internal protocols to protect member confidentiality at every stage of our Services. You acknowledge that unauthorised disclosure of another member's Confidential Information may cause harm that cannot be adequately compensated by damages alone, and that injunctive relief may be sought. This clause survives the termination or expiry of your membership.
11. Privacy
Our collection, use, storage and disclosure of your personal information — including any use of your information for marketing purposes, direct marketing communications, and cookies or online tracking — is governed by our Privacy Policy. Where we seek your separate consent for a particular use of your personal information (for example, using your photo or testimonial for marketing), that consent is sought independently of your acceptance of these Terms, and declining it will not affect your membership or access to the Services.
12. General
These Terms are governed by the laws of South Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia.
We may update these Terms from time to time and will provide reasonable notice of material changes. Your continued use of the Services after the effective date of any changes constitutes acceptance of the amended Terms.
A waiver of any breach of these Terms is only effective if made in writing and is limited to the specific instance referred to.
