1. Your Personal Information
By providing your personal information to us, you consent to the collection, use, disclosure, and storage of your personal information as described in this Privacy Policy. We will only collect and use your personal information to provide our Services.
The types of information we collect may include your:
- full name, date of birth, and contact details;
- relationship history, family background, and lifestyle information;
- personality traits, values, interests, and relationship goals (as disclosed in the intake questionnaire and consultation);
- photographs (where provided);
- email address and phone number; and
- billing details and limited payment information (noting that full card and bank account details are collected and held by Stripe, not by us, in accordance with our Payment Terms).
In limited circumstances, we may also collect sensitive information from you, including information relating to your criminal records and identity checks where relevant.
2. Sensitive Information and Consent
In addition to the personal information described above, we collect certain categories of "sensitive information" as defined under the Privacy Act, specifically:
- information about your criminal record, collected as part of our screening process; and
- information from which your sexual orientation or gender identity may reasonably be inferred, collected through your intake questionnaire (for example, your gender identity and the gender(s) you are seeking).
We only collect this sensitive information with your express consent, which you provide by submitting your membership application and intake questionnaire, and by consenting to our screening process as set out in our Terms and Conditions. We collect this information solely for the purposes of assessing your eligibility for membership, verifying your identity and safety for the benefit of our members, and facilitating compatible introductions. We do not use or disclose your sensitive information for any other purpose without your further consent, except where required or authorised by law.
You may withdraw your consent to the collection of sensitive information at any time by contacting us at hello@magnetiqagency.com.au; however, as this information is necessary for us to assess your eligibility and provide the Services, withdrawing consent may mean we are unable to continue your membership.
3. Compliance
We will comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles when collecting and handling your personal information. We will not use your personal information for any purpose inconsistent with this Privacy Policy.
4. Disclosure to Third Parties
We may disclose your personal information to third parties who assist us in operating our business and providing our Services, including our payment processor (Stripe), IT and cloud hosting providers, professional advisers, and screening and identity verification providers. We will take reasonable steps to ensure that any such third party handles your personal information in accordance with the Australian Privacy Principles or a comparable standard, and only to the extent reasonably necessary for the purpose for which it was disclosed. We do not sell your personal information to any third party.
As the core purpose of our Services, we also disclose relevant profile information — such as your first name, photographs, and the details of your intake questionnaire relevant to compatibility — to prospective matches for the purpose of facilitating introductions. We do not disclose your full contact details, address, or background/identity check results to other members. This disclosure, and your obligations regarding other members' information, is further described in our Terms and Conditions.
Some of the third parties referred to above may store or process personal information on servers located outside Australia. Where this occurs, we will take reasonable steps to ensure that any overseas recipient handles your personal information in a manner consistent with the Australian Privacy Principles, to the extent required by the Privacy Act.
5. Marketing and Promotional Use of Your Information
With your separate and express consent, we may use your first name, photograph(s), and/or a de-identified or anonymised account of your experience (for example, a testimonial or success story) for marketing and promotional purposes, including on our website, social media channels, and other marketing materials. We will never use your full name, contact details, or any identifying details of another member without further consent.
You may provide, decline, or withdraw this consent at any time by contacting us at hello@magnetiqagency.com.au. Declining or withdrawing this consent will not affect your membership or your access to our Services. Where you withdraw consent, we will remove your image and testimonial from future use as soon as reasonably practicable, but this may not extend to materials already published or in circulation (for example, printed materials already distributed).
6. Direct Marketing Communications
We may send you direct marketing communications, such as newsletters, event invitations, and promotional offers, by email or other electronic means, where you have consented to receive them or in other circumstances permitted by law. Each marketing communication will identify Magnetiq as the sender and include a functional facility to unsubscribe or opt out.
You may opt out of receiving marketing communications from us at any time by using the unsubscribe link provided in any such communication, or by contacting us at hello@magnetiqagency.com.au. Opting out of marketing communications will not affect service-related communications necessary for us to provide the Services (for example, notices about your membership, matches, or account).
7. Cookies and Online Tracking
Our website uses cookies and similar tracking technologies to operate effectively, understand how visitors use our website, and, where you have consented, to deliver relevant advertising. This may include analytics tools (such as Google Analytics) and advertising or retargeting tools (such as Meta/Facebook Pixel or Google Ads), which may collect information such as your IP address, browsing behaviour, and device information, and may share this information with the relevant platform provider for advertising purposes.
You can control or disable cookies through your browser settings; however, some parts of our website may not function properly if you do so. Where required by law, we will seek your consent before using non-essential cookies.
8. Retention
We will retain your personal information only for as long as is necessary to provide the Services, to comply with our legal and regulatory obligations, or to resolve any disputes, after which we will take reasonable steps to destroy or de-identify that information.
9. Data Breaches
If we experience a data breach involving your personal information that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner in accordance with the notifiable data breach scheme under the Privacy Act.
10. Access and Correction
You may request access to, or correction of, the personal information we hold about you at any time by contacting us at hello@magnetiqagency.com.au. We will respond to your request within a reasonable time and in accordance with the Privacy Act. If you wish to make a complaint about how we have handled your personal information, you may contact us in the same way, and if you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner.
11. Collection and Storage
We collect your personal information when you communicate with us by email, telephone, in person, via our website, or otherwise. We may also collect technical information from your devices, which may include your IP address, date and time of use, operating system, browser type, and device settings — see Section 7 above for details on cookies and online tracking specifically.
To the extent possible, we will collect your personal information directly from you. We may hold your personal information in either electronic or hard copy form, or through third party data storage providers. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure, using physical, administrative, personnel and technical measures.
12. Your Choices
You decide how much personal information you wish to share with us and you may choose not to provide personal information to us at any time. However, if you do not provide the mandatory personal information or any other information we require, or if you provide inaccurate or incorrect information, we may not be able to:
- consider your application for membership;
- provide the Services that you have requested; or
- respond to your enquiry or request.
